This paper offers a narrative approach to understanding the process of clinical reasoning in complex cases involving medical uncertainty, moral ambiguity, and futility. We describe a clinical encounter in which the pediatric health care team experienced a great deal of conflict and distrust as a result of an ineffective process of interpretation and communication. We propose a systematic method for analyzing the technical, ethical, behavioral, and existential dimensions of the clinical reasoning process, and introduce the Clinical Reasoning Discussion Tool—a dialogical (...) and interpretive device aimed at improving communication, understanding, empathy, and moral deliberation in the clinical setting. Immanuel Kant's Groundwork of the Metaphysics of Morals of 1785 is one of the most profound and important works in the history of practical philosophy. In this introduction to the Groundwork, Sally Sedgwick provides a guide to Kant's text that follows the course of his discussion virtually paragraph by paragraph. From the various discussions of Kant’s theoretical philosophy throughout Hegel’s works, it is not difficult to come away with the impression that Hegel thinks that the Kantian categories are derived from experience, and that the method of a “transcendental” investigation of the forms of subjectivity is nothing other than that of generalization upon observation. As early as the 1802-03 essay, Faith and Knowledge, for example, he characterizes the critical philosophy as the “completion and idealization” of Lockean “empirical psychology.” In § (...) 41 of the Encyclopedia he tells us that Kant’s systematization of the “special forms of the a priori element … of thought … is solely based upon psychological and historical grounds.” Moreover, in the Lectures on the History of Philosophy, he refers to Kant as going “psychologically,” i.e., “historically,” to work in his accounts of intuition, understanding, and reason in a manner that is “entirely empirical, and not developed out of the concept.”. ABSTRACT:We combine prior research on ethical decision-making in organizations with a rational choice theory of corporate crime from criminology to develop a model of corporate offending that is tested with a sample of U.S. managers. Despite demands for increased sanctioning of corporate offenders, we find that the threat of legal action does not directly affect the likelihood of misconduct. Managers’ evaluations of the ethics of the act, measured using a multidimensional ethics scale, have a significant effect, as do outcome expectancies (...) that result from being associated with the misconduct but not facing formal sanctions. The threat of formal sanctions appears to operate indirectly, influencing ethical evaluations and outcome expectancies. Obedience to authority also affects illegal intentions, with managers reporting higher prospective offending when they are ordered to engage in misconduct by a supervisor. (shrink)

Soma‐to‐germline feedback is forbidden under the neo‐Darwinian paradigm. Nevertheless, there is a growing realization it occurs frequently in immunoglobulin (Ig) variable (V) region genes. This is a surprising development. It arises from a most unlikely source in light of the exposure of co‐author EJS to the haplotype data of RL Dawkins and others on the polymorphism of the Major Histocompatibility Complex, which is generally assumed to be the most polymorphic region in the genome (spanning ∼4 Mb). The comparison between the (...) magnitude of MHC polymorphism with estimates for the human heavy chain immunoglobulin V locus (spanning ∼1 Mb), suggests IGHV could be many orders of magnitude more polymorphic than the MHC. This conclusion needs airing in the literature as it implies generational churn and soma‐to‐germline gene feedback. Pedigree‐based experimental strategies to resolve the IGHV issue are outlined. This latest philosophical text by John Sallis is inspired by the work of contemporary Chinese painter Cao Jun. It carries out a series of philosophical reflections on nature, art, and music by taking up Cao Jun's art and thought, with a focus on questions of the elemental. Sallis's reflections are not a matter of simply relating art works to philosophical thought, as theoretical insights and developments run throughout Cao Jun's writings and inform many of his artistic works. Sallis maintains abundant (...) points of contact with Chinese philosophical traditions but also with Western philosophy. In these reflections on art, Sallis poses a critique of mimesis and considers the relation of painting to music. He affirms his conviction that the artist must always turn to nature, especially as reflections on the earth and sky delimit the scale and place of what is human. In recent years there has been increased focus on supporting the safety and wellbeing of children and young people with disability. This paper reports on a study that asked children and young people with disability and adults who work with them about practices that support their wellbeing and safety, including barriers and enablers to ethical practice. We used the theory of practice architectures to unpack the practices. Findings point to a range of practices that both young people and adults regarded (...) as important in creating the cultural conditions for young people to feel happy, safe and well, albeit placing different emphases on particular practices. Several tensions within and between these practices and the evolving requirements of disability and safeguarding policy environments were also apparent. While often not well articulated, the inherent tensions have implications when considering what children and young people need, particularly those with higher support needs. Findings suggest closer attention needs to be given to the intersection between individual and systemic factors in shaping ethical practice aimed at supporting the wellbeing and safety of children and young people with disability. Following is an edited interview with both of the winners.Buddhist-Christian Studies: What made each of you want to put together this collection of essays?Paul Ingram: Before I met Fred at the first "East-West Religions in Encounter" meeting organized by David Chappell in 1980 in Hawai'i, I was well acquainted with his work in history of religions. Fred by this time was recognized as one of the most important scholars in the field, and I deeply admired his work, particularly his book on Nagarjuna. As it turns out, he had read some of my work on Pure Land Buddhism and was as interested in meeting me as I was in meeting him. We became friends and colleagues. Because of our mutual interest in interreligious dialogue in general and in Buddhism in particular, he suggested that we should co-edit a volume of selected papers from the 1980 conference. This short commentary reflects on policy making for open data. The articles in this special issue all raise interesting challenges and questions for research policy, broadly defined, including how to stimulate researchers to make data open in the first place, how to reuse data sensibly, and how to ensure data are appropriately stored and made accessible for future users. This commentary reflects on the author’s own experience of taking part in an international policy forum that was tasked with preparing a (...) report about the importance of making research data open. The author describes how she attempted to ensure insights from science and technology studies—made by contributors to this special issue and many others in the field—were incorporated in the final report. As the nation's single largest sponsor of biomedical and behavioral research, the National Institutes of Health seeks to exemplify and promote human research protections and the (...) highest level of scientific integrity, public accountability, and social responsibility in the conduct of science. The NIH is committed to protecting the rights and welfare of research participants and to upholding integrity standards for research supported with public funds. This article deals with legal corporate behavior and corporate structures. It discusses the activity within and between business units. It explains studies on corporate behavior in a threefold order—the first order deals with the gap between formal legal contracts and informal corporate covenants; the second order deals with norms that govern alternative contractual norms; and the third order exclusively deals with the economic aspects of the study. The legal-economic approach tries to identify the gap between actual behavior and ideal behavior. (...) This article demonstrates that investors are claimed to be non-interventionist and only the investor's direct involvement necessitates direct monitoring. [Sally Haslanger] In debates over the existence and nature of social kinds such as 'race' and 'gender', philosophers often rely heavily on our intuitions about the nature of the kind. Following this strategy, philosophers often reject social constructionist analyses, suggesting that they change rather than capture the meaning of the kind terms. However, given that social constructionists are often trying to debunk our ordinary (and ideology-ridden?) understandings of social kinds, it is not surprising that their analyses are counterintuitive. This (...) article argues that externalist insights from the critique of the analytic/synthetic distinction can be extended to justify social constructionist analyses. /// [Jennifer Saul] Sally Haslanger's 'What Good Are Our Intuitions? Philosophical Analysis and Social Kinds' is, among other things, a part of the theoretical underpinning for analyses of race and gender concepts that she discusses far more fully elsewhere. My reply focuses on these analyses of race and gender concepts, exploring the ways in which the theoretical work done in this paper and others can or cannot be used to defend these analyses against certain objections. I argue that the problems faced by Haslanger's analyses are in some ways less serious, and in some ways more serious, than they may at first appear. How can a book, for example, open in the morning and shut in the afternoon, persist through a change that involves the incompatible properties of being open and being shut? The goal of this reader is to inform and reframe the philosophical debate around persistence; it presents influential accounts of the problem that range from classic papers by W. V. O. Quine, David Lewis, and Judith Jarvis Thomson to recent work by contemporary philosophers. (...) The authors take on the question of persistence by examining three broad approaches: perdurantism, which holds that change over time is analogous to change over space; exdurantism, according to which identity over time is analogous to identity across possible worlds; and endurantism, which holds that ordinary objects persist by enduring. In lieu of an abstract, here is a brief excerpt of the content:Hume Studies Volume 28, Number 1, April 2002, pp. 113-130 Bayesianism, Analogy, and Hume's Dialogues concerning Natural Religion SALLY FERGUSON Introduction Analyses of the argument from design in Hume's Dialogues concerning Natural Religion have generally treated that argument as an example of reasoning by analogy.1 In this paper I examine whether it is in accord with Hume's thinking about the argument to subsume the version of it given (...) in the Dialogues under the model of probabilistic reasoning offered by Bayes's theorem. Wesley Salmon attempted this project in 1978.2 In related projects, David Owen3 as well as Philip Dawid and Donald Gillies4 have more recently attempted to construct Bayesian analyses of Hume's argument concerning testimony in "Of Miracles." I want to be careful at this stage to note exactly what I will claim. It is not that Bayesian reasoning sheds no light on the argument from design, or on arguments concerning testimony. All of the analyses mentioned above are beneficial in that they have been able to expose subtleties in these arguments that had previously gone unnoticed. Salmon's paper, in particular, contributes nicely to an understanding of just how the design argument may function in relation to contemporary scientific reasoning. In this paper I argue that, nonetheless, the attempt to apply Bayesian reasoning to the argument as presented in the Dialogues is not well supported as a reconstruction of Hume's own approach to the argument from design. I begin by considering how much Hume knew of Bayes's theorem, and what consequence that knowledge might have had on his treatment of the argument in the Dialogues. This discussion includes a consideration of exactly what has been claimed by other authors on this subject, including what some have argued concerning Hume's reasonings in "Of Miracles," section 10 of An Enquiry concerning Human Understanding. I conclude that, based on the historical data, there is little reason to think of Hume's approach to the argument from design as anything more than proto-Bayesian at best. I then argue further, through a close textual analysis of the Dialogues, that there are good reasons for not treating Hume's reasoning there as even proto-Bayesian. In the end, the benefits that have been claimed for that approach, in terms of exposing both the subtleties of the argument and of Hume's reasoning about it, can equally well be derived from a careful analysis of the argument under a model of analogical reasoning, without need of Bayes's theorem. Section One Perhaps one might think that there is not much use for a consideration of the question whether Hume himself conceived of any of his arguments along specifically Bayesian lines. As Gower argues,5 Hume's knowledge of mathematics in general was fairly limited, and Bayes's theorem was not well known even up until Hume's death. It is important, therefore, for me to establish that there have not only been those who thought that Bayesian reasoning illuminates the arguments Hume gave, but also his own thinking about those arguments. It is also important for me to establish that it is not obvious that knowledge of Bayes's theorem did not affect Hume's reasonings. Each of these points will be addressed in the following. As to the first point, the claims of some authors on the subject are ambiguous. Dawid and Gillie, for example, make no statement to the effect that the probabilities involved in Bayes's theorem were in fact examined in "Of Miracles," nor do they attempt to produce any passages from Hume in support of that view. Thus it would be assumed that they see their attempt not as an attempt to provide an analysis that represents Hume's own approach to the argument, but rather simply as one that provides an illuminating method of analysis and support for an argument that Hume happened to give. Argument is a pervasive feature of human interaction, and in its natural contexts of occurrence, it is organized around the management of disagreement. Since disagreement can occur around any kind of speech act whatsoever, not all arguments involve a claim supported by reasons; many involve standpoints attributed to someone but claimed by no one. And although truth and validity are often at issue in naturally occurring arguments, these do not exhaust the standards to which arguers are held. Arguers hold one (...) another accountable for cooperating in the management of disagreement, infusing argumentation with a natural normativity that exists apart from any theorized appraisal standard applied to the claim-reason relationship. Argumentation’s natural normativity is visible not only in how arguments unfold in interaction but also in how humanity continuously strives to improve its methods of disagreement management. Gender is the social meaning of a person’s sex, and race is the social meaning of a person’s color. This paper reviews some accounts of these social meanings. It is argued that there are important differences between race and gender that count against treating them as parallel.

Contemporary reasoning about health is infused with the work products of experts, and expert reasoning about health itself is an active site for invention and design. Building on Toulmin’s largely undeveloped ideas on field-dependence, we argue that expert fields can develop new inference rules that, together with the backing they require, become accepted ways of drawing and defending conclusions. The new inference rules themselves function as warrants, and we introduce the term “warranting device” to refer to an assembly of the (...) rule plus whatever material, procedural, and institutional resources are required to assure its dependability. We present a case study on the Cochrane Review, a new method for synthesizing evidence across large numbers of scientific studies. After reviewing the evolution and current structure of the device, we discuss the distinctive kinds of critical questions that may be raised around Cochrane Reviews, both within the expert field and beyond. Although Toulmin’s theory of field-dependence is often criticized for its relativism, we find that, as a matter of practical fact, field-specific warrants do not enjoy immunity from external critique. Research evidencing the consequences of the experience of ‘calling’ have multiplied in recent years. At the same time, concerns have been expressed about the conceptual coherence of the notion as studies have posited a wide variety of senses in which both workers and scholars understand what it means for workers to be called, what they are called to do and who is doing the ‘calling’. This paper makes both conceptual and empirical contributions to the field. We argue that Bellah et (...) al.’s (Habits of the heart: Individualism and commitment in American life, University of California Press, 1996) contrast between tradition-based and expressivist understandings of ‘calling’ highlights a fundamental but neglected fissure in the literature. Expressivist accounts amongst both scholars and research participants require only that ‘calling’ be deeply felt by those who experience it. However, tradition-based accounts require an external caller. Exemplifying this, workers who attest to a divine call and scholars who write about ‘calling’ in the context of particular Christian traditions understand ‘calling’ in terms of a relationship with God. These accounts cannot but be in radical tension. We suggest that this conceptual confusion can be understood in terms of MacIntyre’s notion of ‘tradition-constituted rationality.’ The implications of this argument for practice are evidenced in our report of a study of adherents to one such tradition, workers at a Christian organization that supports people in poverty. Through in-depth interviews with long-term volunteers, we seek to assess if tradition-based ‘calling’ can be evidenced in unpaid work for the lack of pay and career progression opportunities strongly suggest the presence of ‘calling.’ This study demonstrates that even in the context of work that exhibits duty and altruism associated with expressivist accounts of ‘calling,’ these workers’ understanding of the relationships between themselves, their clients and Jesus Christ dominate their work choices. It is the meaning derived from a divine caller, understood in terms of Christian tradition, that accounts for their decision to begin and to continue this work. (shrink)

This essay proposes a design perspective on argumentation, intended as complementary to empirical and critical scholarship. In any substantive domain, design can provide insights that differ from those provided by scientific or humanistic perspectives. For argumentation, the key advantage of a design perspective is the recognition that humanity’s natural capacity for reason and reasonableness can be extended through inventions that improve on unaided human intellect. Historically, these inventions have fallen into three broad classes: logical systems, scientific methods, and disputation frameworks. (...) Behind each such invention is a specifiable “design hypothesis”: an idea about how to decrease error or how to increase the quality of outcomes from reasoning. As problems in contemporary argumentation practice become more complex, design thinking rises in relevance and importance. Drawing on theories of structure and agency, this article assesses how women in lower-income households in Damascus use existing gender schemas to avoid unattractive employment and improve their access to income and employment. It highlights the overlapping effects of economic policy and gender dependency schemas on both the need for additional income and women's employment opportunities. While providing greater access to resources, women's accommodation to gender dependency schemas also helps to maintain domesticity and dependence on men. Philosophical reflection proposes a return to self as the condition required of a genuinely radical transcendental philosophy. This proposal has its proper ground. It is not an ideal externally imposed upon reflection but rather springs from the very structure of reflection itself in its relation to the reflected. It has its source, specifically, in the capacity on the part of reflection to gain mastery over any proposed external condition in the sense that the very posing of such a condition, presumed (...) to mark the limit of reflection, proves, in the end, to be itself the work of reflection. To the extent that reflection, as re-enactment, poses the limit for itself, it thereby represents the limit in such fashion as to exhibit it as having already been, at the unreflected level, no more than a constitutive product. To the degree that reflection brings an external limit to light, it reveals that limit as sustained precisely by the light which illuminates it, and hence, it dissolves its externality. Thus, philosophical reflection proposes a return to self which is achieved in an act of total reflection. Such reflection first opens up the domain of philosophical thought by actualizing at a single stroke the ideal born of the first act of reflection. It places itself from the very outset at the terminal point of the transcendence from perspectivity to objectivity whose inherent incompleteness defines our perceptual life, and it claims not only to have achieved this vantage point but also to have brought objectivity totally under its command, to have subjugated it by elevating itself to that position which is no longer really a position at all, that position from which objectivity is only for-consciousness. The return to self is a reflective appropriation of the pre-reflective through which the identity of reflection with the reflected is established in such a way that all that remains to be accomplished is the explication by reflection of what is already totally, though still implicitly, appropriated to it. The authentic task of philosophical thought is to render the implicit explicit. Transcendental philosophy is thus obliged to insist that with the very inception of genuinely philosophical thought the subject is already implicitly a pure presence of itself to itself, a presence which is, in principle, totally transparent. The subject is pure inferiority, and the way is prepared for asserting, with Hegel, that “Spirit is Being-within-itself.” Even its own return to itself by which it first reaches the level of philosophical thought is, in the end, taken up into the circuit of self-presence definitive of this level and appropriated in such a fashion that the shadows which made this path of self-discovery into a highway of despair are banished by the high noon of reflection; the subject's own constitutive history is transformed without residue into a history constituted by the subject. The last discussion I had with Reiner Schürmann concerned Platonism. The discussion was occasioned by a lecture here at the New School in which I undertook to show how certain Platonic texts inscribe a kind of limit that would be precisely a limit of kinds, hence of the metaphysics of selfsame kinds that one otherwise takes these texts simply to have founded. The operation of such a limit has the effect of exposing Platonic thought to a primal contamination, opening it (...) to an unassimilable alterity at the very moment when, founding what will be called metaphysics, it would declare the hegemony of the same, of what is one and the same. Such alterity is thought in the Timaeus as what is called the third kind, though it would be, of necessity, a kind of kind beyond kinds: Timaeus’s name for it is χώρα. (shrink)

Grace Hibshman has developed a new explanation for why narrative self-conceptions might contribute to one’s flourishing: conceiving of one’s life narratively, she argues, can facilitate an improved self-understanding. In this short paper, we argue that, pace Hibshman, life narratives tend to misrepresent and mislead. So while they may give the impression of an improved self-understanding, that impression is typically mistaken. In this respect, conceiving of one’s life narratively hinders flourishing.

On se propose ici de reconstituer les étapes du dialogue que l’auteur a entretenu avec Jacques Derrida au sujet de la question et de l’importance de la chora dans le Timée de Platon, dialogue qui s’est poursuivi pendant plus de deux décennies. On tente, en revenant aux textes de Derrida, de renouveler les questions qui ont fait l’objet de ce dialogue, en particulier celles qui ont trait au statut métaphorique ou non métaphorique de la chora et au rapport que celle-ci (...) entretient avec le bien en tant qu’il est situé « au-delà de l’être » et qu’il unit donc en soi générosité et réserve. V članku skušam opredeliti vlogo pojma protislovnosti v zgodovini metafizike. Podrobnejši vpogled v Aristotelovo mišljenje o tem pojmu pokaže, v kolikšni meri je načelo neprotislovnosti zakoreninjeno v metafiziki. V nadaljevanju se osredotočam na Kantovo razvijanje transcendentalne logike in Heglovo izenačenje logike z metafiziko. V zaključku razmišljam o možnosti drugačne logike – logike preobilja – onkraj heglovske afirmacije protislovnosti, ki razkriva mejo principa protislovnosti znotraj določenih struktur ali elementov.This paper traces the role that the concept of contradiction plays in the history (...) of metaphysics. By investigating the way that this concept was taken up by Aristotle, it shows how thoroughly the principle of non-contradiction belongs to metaphysics. The paper then traces Kant's development of a transcendental logic and Hegel's identification of logic and metaphysics. The paper explores, finally, the possibility that even beyond Hegelian affirmation of contradiction another logic--an exorbitant logic--can be conceived that exposes the limits of the principle of non-contradiction and accordingly affirms contradiction whithin certain domains of structures or elements. Engaged Buddhism is the contemporary movement of nonviolent social and political activism found throughout the Buddhist world. Its ethical theory sees the world in terms of cause and effect, a view that discourages its practitioners from becoming adversaries, blaming or condemning the other. Its leaders make some of the most important contributions in the Buddhist world to thinking about issues in political theory, human rights, nonviolence, and social justice. Being Benevolence provides for the first time a rich overview of the (...) main ideas and arguments of prominent Engaged Buddhist thinkers and activists on a variety of questions: What kind of political system should modern Asian states have? What are the pros and cons of Western "liberalism"? Can Buddhism support the idea of human rights? Can there ever be a nonviolent nation-state? It identifies the roots of Engaged Buddhist social ethics in such traditional Buddhist concepts and practices as interdependence, compassion, and meditation, and shows how these are applied to particular social and political issues. It illuminates the movement’s metaphysical views on the individual and society and goes on to examine how Engaged Buddhists respond to fundamental questions in political theory concerning the proper balance between the individual and society. The second half of the volume focuses on applied social-political issues: human rights, nonviolence, and social justice. (shrink)
